General Terms and Conditions

1. Scope of Application

These General Terms and Conditions apply to all contracts concluded via the Strategify website (hereinafter “we”, “us”). By purchasing a service on our website, customers (hereinafter “customer”) agree to these Terms and Conditions.

2. EU AI Act: Declaration on the Use of Artificial Intelligence “AI” at Strategify

At Strategify.ch, we use modern AI technologies such as Perplexity, Claude, ChatGPT, CoPilot, or other GenAI tools to assist you in creating your application documents. The AI serves merely as a tool to provide you with an additional perspective (“second opinion”).
Important: All decisions regarding your application documents are made by you. The AI does not make automated decisions but helps you draft your documents professionally. We recommend that you carefully review the results and adapt them to your needs. This way, you always remain in control!

3. Subject Matter and Description of Services

Strategify provides intangible services based on information that customers provide to us.

Our services include, among others, consulting and analysis services specifically tailored to the needs of customers.

The descriptions of individual services on our website are binding, subject to any changes or errors.

4. Contract Formation

By clicking the “Buy” button in the web shop, the customer submits a binding offer to conclude a purchase contract.
The contract is only formed upon our written confirmation by email or through the provision of the service.

5. Payment Terms

All services must be paid in advance. Receipt of payment is a prerequisite for the provision of the agreed service.

Payment can be made using the payment methods specified on our website.
After successful payment, the customer will receive a confirmation by email.

6. Customer Obligations to Provide Information

The customer undertakes to provide us with all necessary information required for the provision of the service.

Strategify reserves the right to commence the service only after receiving all required information and upon its review.

The customer guarantees that the information provided is correct and complete. Incomplete or incorrect information may result in delays or termination of the service.

7. Handling of Information and Data Protection

Strategify undertakes to handle the information provided by the customer carefully and confidentially. The information will be used exclusively for the purpose of providing the commissioned services.

Strategify expressly undertakes not to use customer information for its own projects or otherwise exploit it unless the customer has provided explicit written consent.
All information is subject to our privacy policy and is processed in accordance with applicable data protection laws.

We implement appropriate technical and organizational measures to ensure the protection of information and safeguard it against unauthorized access.

8. Liability

To the extent permitted by applicable law, neither Strategify nor its partners, shareholders, consultants, employees, affiliated companies, or other representatives of Strategify shall be liable for losses or damages arising from or in connection with the use of the materials or facilities or services offered through this website (including, but not limited to, indirect or consequential damages, loss of data, income, profit, or opportunities, loss or damage to property, and third-party claims), even if Strategify has been advised of the possibility of such losses or damages or such losses or damages were reasonably foreseeable.

When providing information, the customer bears responsibility for the accuracy and completeness of the information. Strategify assumes no liability for damages resulting from incomplete or incorrect information provided by the customer.

Strategify is not liable for loss of profit or intangible damages.

9. Warranty and Complaints

Strategify warrants that services will be provided in accordance with contractual agreements and with due care.

If defects in the service provided are identified, the customer must notify us in writing within 14 days of receiving the service.

Strategify will, if justified, either remedy the defects or offer an appropriate substitute performance of the service. Further claims are excluded.

10. Cancellation Terms

Consulting: If the client terminates a consulting project prematurely, all expenses incurred up to that point plus 50% of the expenses not yet incurred according to the contract are due.

Coaching: After a non-binding and free initial consultation, the amounts owed as stated in the offer are due upon commencement of the coaching program, even if the program is terminated prematurely. For health reasons or due to extended absences, the program and/or coaching may be interrupted, but for no longer than 3 months.

Individual Coaching Sessions: After a non-binding and free initial consultation, appointments for individual coaching sessions are scheduled individually. The agreed costs apply for coaching sessions conducted. Cancellations within 24 hours will be charged at 50%.

Training: For cancellations later than 45 days before the training date, 50% will be charged, and for cancellations later than 30 days before the event, the full seminar price will be charged. If no written cancellation is received, the full seminar price becomes due.

Expenses and Third-Party Costs: Travel expenses based on actual costs (train 1st class or car CHF 0.85/km), meals/accommodation based on actual costs. Costs for third-party services such as hotels, translations, and production of materials will be borne by the client or invoiced unless otherwise agreed.

11. Right of Withdrawal

As these are intangible services created individually for the customer, there is no statutory right of withdrawal after the service has been provided.

12. Severability Clause

Should these provisions or parts of these provisions be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a provision that comes closest to its economic intent.

13. Applicable Law and Jurisdiction

The Terms and Conditions of Strategify are governed by Swiss law. The place of jurisdiction for all disputes arising from or in connection with these Terms and Conditions is Aarau, Switzerland.
